2) Acceptance of these Terms

By accessing or using our website or placing an order, you agree to these Terms and to our Privacy Policy and Returns & Warranty Policy (collectively, the “Policies”). If you do not agree, please do not use the website.

3) Eligibility & Accounts

You must be 18 years or older or use the site under the supervision of a parent/guardian.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
We may refuse registration, suspend, or close accounts at our discretion (e.g., suspected fraud, abuse, or violation of these Terms).

4) Products, Content & Availability

We sell physical products (e.g., consoles, accessories, boxed games) and digital content (e.g., activation codes/keys, top‑ups).
Product images are for illustration; actual items may vary slightly.
All items are subject to availability. We may limit quantities per customer.
Digital game keys may be region‑locked and require compatible hardware, accounts (e.g., Steam, Xbox, PlayStation, Nintendo), and internet access. You are responsible for checking compatibility before purchase.

5) Prices, Taxes & Promotions

Prices are shown in South African Rand (ZAR) and include VAT where applicable, unless stated otherwise.
We may change prices and promotions at any time.
If a price is incorrect due to an obvious error, we may cancel your order and refund any amounts paid.
Promotions and coupon codes may have additional conditions and expiry dates.

6) Ordering & Contract Formation

Your order is an offer to buy. We accept once we dispatch the physical goods or, for digital content, once we deliver or display the activation code (whichever occurs first).
We reserve the right to refuse or cancel an order (e.g., stock errors, suspected fraud, pricing mistakes, regulatory reasons).
We will promptly refund any amounts paid if we cancel before acceptance.

7) Payment

We accept the payment methods shown at checkout (e.g., card, EFT/instant EFT, approved pay‑over‑time providers).
By paying, you confirm that you are authorized to use the selected payment method and that the information provided is accurate.
Orders may be held until payment clears.

8) Delivery, Shipping & Risk

Physical goods

We deliver within South Africa using reputable couriers. Estimated delivery times shown at checkout are guidelines only.
Shipping costs are shown at checkout.
Risk of loss passes on delivery to the address provided. Title passes upon full payment.
Inspect parcels upon delivery and log visible damage with the courier and with us within 48 hours.

Digital content

Digital items (e.g., keys) are delivered electronically, typically by email, account area, or on‑screen reveal.
Keep digital keys secure. You are responsible for any use or redemption after delivery.

9) Returns, Refunds & Cancellations

Digital content (keys, codes, top‑ups):

Non‑returnable and non‑refundable once the key/code has been delivered or revealed (including partial reveal) or once redeemed, except where required by law (e.g., not as described, defective, or unavailable).
If you have not yet received or viewed the key, contact us immediately to request cancellation.

Physical goods:

You may return unopened, unused items within 7 days of delivery in original packaging for a refund or store credit, excluding shipping fees, unless otherwise required by law.
If an item is defective or not as described, contact us within a reasonable time. We will assess and, if validated, repair, replace, or refund in accordance with applicable consumer laws and manufacturer warranties.
To start a return, contact us with your order number, issue, and photos (if relevant). We will provide return instructions and a return merchandise authorization (RMA) if approved.

Pre‑orders:

Release dates are estimates and provided by publishers/manufacturers. Delays may occur. You may cancel a pre‑order before we dispatch/provide the key; after delivery or key reveal, the digital content rules apply.

10) Warranties & Disclaimers

Hardware may include a manufacturer’s warranty. We facilitate claims where possible; final decisions rest with the manufacturer.
Software and digital content are provided “as is” by the publisher/platform. We do not guarantee uninterrupted or error‑free operation, compatibility with your system, or continued availability of online services.
Nothing in these Terms limits rights you may have under applicable consumer laws.

11) Your Responsibilities

Use the website lawfully and do not interfere with its security or other users.
Ensure age‑appropriate purchases: some games are age‑restricted. By buying or redeeming, you confirm you meet the relevant age rating or have guardian consent.
Check region compatibility and system requirements before buying.

12) Third‑Party Services & Platforms

Some products require third‑party accounts (e.g., Steam, Xbox, PlayStation, Nintendo) and are subject to those providers’ terms.
We are not responsible for third‑party services, outages, or policy changes.

13) Intellectual Property

All product names and logos belong to their respective owners and are used for identification only.

14) Suspension & Termination

15) Indemnity

You agree to indemnify and hold harmless ElectroGames, its directors, employees, and agents from claims, losses, damages, liabilities, costs, and expenses arising from your breach of these Terms or misuse of the website or products, except to the extent caused by our negligence or willful misconduct.

16) Limitation of Liability

To the maximum extent permitted by law:

We will not be liable for indirect, incidental, special, or consequential losses; lost profits; or loss of data arising from your use of the website, products, or digital content.
Our total aggregate liability for any claim is limited to the amount you paid for the product giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under law.
